Terms & Conditions

BOOKINGS

 

Bookings are confirmed, once we receive full payment. Prices are quoted in $AU. Payment can be made either by direct deposit, credit card (Mastercard, Visa), cash ($AU only) or cheque (10 business days before your tour only). Cheques should be made payable to Spacechameleon Adventure Co.

For multi day trips, we strongly advise that participants take out travel insurance.

 

CANCELLATION DUE TO CHANGE OF MIND OR CIRCUMSTANCE

 

In the event of a change of mind or circumstance, we will endeavor to accommodate you wherever possible. We are not without heart and understand that life and circumstances may dictate a change of direction. 

However as with all things, certain terms and conditions apply.

Please bear in mind that the preparation and cost for a tour commences well before you arrive. Cost of food, fuel, time and impact on other participants, are all things that have to be taken into account by management when considering a cancellation.

 

Change of Mind

A change of mind prior to tour commencement without proof of extenuating circumstances will result in a forfeiture of your deposit or paid in full amount.

If a customer cancels a tour after commencement, no refund will apply, unless proof of extenuating circumstances can be provided.

 

Late Arrivals

Late arrival may result in forfeiture of tour cost. This applies for tours that depart from a fixed location, at a fixed time, unless proof of extenuating circumstances can be provided.

 

No Show

Failure to show for a course, trip or activity, no refund will be given, unless proof of extenuating circumstances can be provided.

 

Poor Weather Policy

Our activities will normally operate in all but exceptional weather conditions. Rain, wind, cold and fog do not prevent us conducting our tours. Unless you hear from us, assume your tour is going ahead. We will make every effort to inform you if cancelling your scheduled tour is necessary. Participants that decide not to attend/participate on the basis of weather (against our policy and/or advice) forfeit their full tour fare. Where poor weather causes cancellation or changing the nature of a tour, we may offer you the nearest possible alternative tour, a credit or refund. This will be at Spacechameleon Adventure Co's discretion at all times. On multi day trips, especially to remote locations like Karijini, if weather or venue closures occur, no refund can be given due to money having spent on your tour and the nature of the impact on the tour being out of our control. We will alway do our best to provide an alternative option. Participating in an outdoor activity will always come with the potential of unforeseen environmental events that are out of our control, as such no guarantees can be given that the itinerary that you purchased can be delivered. All itineraries serve as guidelines only. Spacechameleon Adventure Co reserves the right to change the nature of a tour when circumstances arise that necessitate this change.

 

Associated Costs

Spacechameleon Adventure is not liable for any costs associated with clients travelling to or from an adventure location if a tour is cancelled due to a Force Majeure Event, such as severe weather, fires, venue closures, pandemics etc.

 

Change of Party Numbers

Please keep us informed of any changes to the numbers in your party. A reduction in numbers may incur charges depending on circumstance. Where there is a minimum requirement, extra charges will apply if your group number drops below this requirement. An increase in numbers may not always be possible. To avoid disappointment, notify us of changes as early as possible.

Changing the Date of your Booking

If you wish to change the date of your booking, we allow one date change free of charge. Beyond this, we charge $20 per date change to allow for associated office time involved in shifting your booking which may involve contacting the venue and/or other clients booked onto your date. The $20 charge must be paid in full before we allocated a new date for your booking. In the case of extenuating circumstances such as illness and/or injury, we may waive this charge. Please contact us to discuss this.

Minimum Numbers

Minimum customer numbers apply for some of our tours. Where sufficient numbers are not achieved, we reserve the right to cancel the tour or offer a suitable alternative tour (subject to a payment for any price difference at our discretion). Alternatively, you may be given the option to pay a surcharge and proceed with the tour as booked. We will inform you prior to your tour if minimum numbers are not achieved and if this surcharge will apply.  If this does not suit you, please see our credit and refund policy.

 

Limitation of Liability

We will not be liable for any additional expenses relating to your tour, including but not limited to: cancellations, missing connecting transport, extra accommodation, damage to clothing or food expenses (unless otherwise arranged). All additional expenses incurred remain the sole responsibility of the customer. Please be mindful that you are engaging in an outdoor activity where clothing may get dirty and/or damaged. We strongly suggest that you wear clothing that is appropriate to the activity in which you are engaging. Spacechameleon Adventure Co will not be held liable for any damage incurred to articles of clothing worn for any of our activities. The onus lies with the participants. If you have any concerns, please contact us prior to the date of your activity.

 

Special Requirements

Any special requirements for customers must be notified to us at the time of booking. This includes but is not limited to physical disabilities, medical conditions, and dietary requirements.

 

Minors

Participants under the age of 18 must have a tour waiver form completed by their parent or guardian. A parent or guardian, except where prior arrangement has been made with management, must accompany participants under the age of 18. Not all of our tours are appropriate or available for people under the age of 18. Please call us to confirm before booking.

 

Tour Cancellation

Participants whose tour is cancelled for any reason, including but not limited to; weather, venue closures, or illness of the tour operator or guide/s, COVID 19, will normally be given a credit for future activities. Refunds or credit transfers may be given at the discretion of management, and can only occur where associated costs incurred by Spacechameleon Adventure Co can be recouped.  If we cancel a tour after commencement for any reason, a credit or partial refund may apply. Credits or partial refunds due to cancellations after commencement will be assessed on a case by case basis.

COVID 19

If you cancel your adventure with us due to a government ordered COVID lockdown that prevents you from attending your adventure on the scheduled tour commencement date (Tour Date):

  • If notified to us more than 14 days before your Tour Date, we will provide you with a full credit of the purchase price already paid by you to be applied towards a future trip or trips with us (Full Credit).

  • If notified to us within 14 days of your Tour Date, we will provide you with a Full Credit, less the cost of any accommodation (where applicable) already pre-booked and paid by us on your behalf (Partial Credit), which we will not get back from the venue. This accommodation cost will vary depending on your trip.

If a Full Credit or Partial Credit is not a suitable option for you, we may consider providing a refund or partial refund to you in our sole discretion, taking into account the circumstances of your cancellation and whether we are able to resell your spot to another client.

CANCELLATION DUE TO UNSUITABILITY AND/OR CHOOSING TO ACT INAPPROPRIATELY

 

For your enjoyment and safety, and that of other participants, although there is no age limit, there is a minimum level of fitness required to participate in most of our adventures. Please take this into consideration when making your booking.

 

Spacechameleon Adventure Co reserves the right to cancel your booking without refund, in the following circumstances:

 

  • If your fitness is not adequate for the activity

  • If your medical condition/ health is not suited for the activity

  • If you ignore the instructions of your guide/s, including but not limited to; proximity to the edges of cliffs, safety guidelines, and respect for the environment. Please do not interfere with, pick up, alter or remove any plant, animal or other natural, historical or cultural feature. Please stick to formed paths, carry all your rubbish out with you and use minimal impact toileting procedures. Take only memories and leave only footprints.

  • Disrespect towards your guide/s, other participants and or general public.

 

 

 

Removal from Tours

We reserve the right to deny access to tours for anyone who in our opinion is drunk, under the influence of drugs, disorderly, a hazard to themselves or others, abusive, not physically able, mentally incapable, or objectionable in any other way. We will not be liable for any additional expenses incurred as a result of your removal or non-participation.

Travel Insurance

Participants are responsible for obtaining comprehensive travel insurance to cover any loss or damage associated with booking and attending their tour, including but not limited to cover for flight cancellations, loss of luggage, ambulance, evacuations, medical costs, and other circumstances that may arise.

 

PRIVACY & SECURITY

 

Spacechameleon Adventure Co recognises that your privacy is important to you, and that it is your right to control your personal information. We know that providing personal information is an act of trust, and we take that seriously. We will never sell, rent or otherwise disclose your personal information, including your email address, to any other third party, without your prior consent. The exception to this, being the handing over of medical and contact details to paramedics and/or medical staff in the event of a medical emergency.

We do not store your financial information. Your payments are processed by PayPal’s secure payment gateway via the PayPal Here application, or EFT bank to bank transfers.

 

 

FINAL WORD

 

The more notice you give us, the more room we have to move and find a suitable and fair solution.

 

Management reserves the discretion as to which circumstances warrant a refund or exchange, and what nature this refund will take; please choose wisely.
